Democrats in Chaos: Push to Oust Sotomayor to Prevent Trump’s Supreme Court Takeover

The Democrats are in disarray, grappling with a dilemma that could shape the future of the U.S. Supreme Court: should they pressure Justice Sonia Sotomayor, the first Latina justice, to step down?

It’s a fight they’d rather keep behind closed doors. But the clock is ticking. With just two months left before Republicans regain control of the Senate, Democratic leaders are panicking over the possibility of Donald Trump appointing another conservative justice.

Sotomayor, though only 70, suffers from Type 1 diabetes and is the oldest of the three remaining liberal justices. The party fears history repeating itself—just as they failed to act when Ruth Bader Ginsburg clung to her seat until her death in 2020.

That decision handed Trump the chance to reshape the Court with the confirmation of Amy Coney Barrett, shifting the balance to the right for generations.

Now, Democrats face an even more precarious situation. Should Sotomayor retire, it’s no guarantee her replacement would make it through a Senate controlled by Republicans. With their slim window of opportunity shrinking, the party is considering whether to urge Sotomayor to retire while they still have the power to name her successor.

But there’s hesitation. Democrats are terrified of another Ginsburg-style blunder, where a resignation opens the door for a failed confirmation battle. “What happens if she resigns and the nominee doesn’t get confirmed?” one Democratic senator asked. “We’d be stuck with Trump’s pick.”

Further complicating the issue is the fear of alienating key Democrats like Joe Manchin, who could veto a replacement nominee. With Republicans like Susan Collins and Lisa Murkowski potentially wavering, the risk of failure is high.

Despite the challenges, the party has reportedly considered Washington D.C. Circuit Judge J. Michelle Childs, who some Republicans see as a moderate. This could offer a slim hope of confirmation, but pushing Sotomayor out is politically perilous. Activists have already accused the party of “ableism” and “racism” for even suggesting such a move against the first Latina justice.

But some party members say the risk is worth it. “Democrats won’t be in power forever,” warned Molly Coleman of the People’s Parity Project. “They need to act while they can.”

The conversation is happening behind the scenes, but the stakes are clear. Democrats know the clock is ticking—and their worst fear is watching the Supreme Court slip further into conservative hands.

  1. The Democrats already pushed Joe Biden aside in favor of Kamala Harris. That didn’t turn out well for them. I’d say they’d better leave well enough alone and not let history repeat itself. While type one diabetes is a serious medical condition, if properly controlled, those who suffer with it can live long, healthy lives. RBG was past her prime and should have retired years ago, instead of standing her ground just to be a thorn in Trump’s side. But hey…I won’t cry if the Dems want to push Sotomayor out.
