In a stunning turn of events, Ghislaine Maxwell’s family is calling for her 20-year prison sentence to be overturned, claiming she was railroaded in a politically motivated prosecution—and even dropping a bombshell theory that Jeffrey Epstein paid someone to kill him behind bars.
Maxwell, now 63 and serving time for sex trafficking and abuse tied to Epstein’s international child exploitation ring, is preparing to file a writ of habeas corpus, her lawyers confirmed. The legal motion is expected to allege government misconduct and procedural manipulation that, if proven, could invalidate her 2021 conviction.
“This wasn’t justice,” her brother Ian Maxwell told reporters this week. “This was public vengeance. They couldn’t put Epstein on trial, so they made Ghislaine the stand-in.”
The Maxwell family claims their sister became a sacrificial lamb following Epstein’s suspicious jailhouse death in 2019—a death still shrouded in mystery. Though officially ruled a suicide, the financier’s demise has spawned widespread conspiracy theories. Now, Ian Maxwell is adding fuel to the fire.
“We believe it’s entirely possible Jeffrey paid someone inside the prison to take his life,” Ian said. “Not a dramatic James Bond hit—but an assisted death, a payoff from a man who had the means and motive.”
The theory, dubbed “suicide by internal killing,” is just the latest twist in a saga that has ensnared billionaires, politicians, and celebrities for over two decades.
Adding to the controversy, former Trump administration Attorney General Pam Bondi confirmed this month that the long-rumored Epstein “client list” does not exist—despite years of speculation linking high-profile figures to Epstein’s illicit network.
“There’s no list. It was never compiled. That fantasy needs to end,” Bondi said.
That revelation has emboldened Maxwell’s defenders, who argue her conviction was based more on public pressure than legal evidence.
“If Epstein was the criminal, why wasn’t his deal honored?” asked Maxwell’s attorney, David Oscar Marcus. “The federal government promised not to go after his alleged co-conspirators. Then they tore that deal up and came after Ghislaine anyway.”
Marcus added, “President Trump, the ultimate dealmaker, would never support a government breaking its word.”
The non-prosecution agreement struck in 2007 between Epstein and the U.S. Attorney’s Office in Florida did state that co-conspirators would be shielded from criminal charges. But Maxwell was charged in New York, where the legal precedent doesn’t carry the same weight.
Her legal team is now asking the courts to settle that discrepancy and vacate her sentence based on what they call an “incorrect guideline range and offense level.”
Maxwell’s family fully backs the motion.
“We believe justice demands a resentencing—or a new trial altogether,” Ian Maxwell said. “She’s not Epstein. She’s not the monster they made her out to be.”
Maxwell’s defenders claim she was dragged into a storm of media outrage and political theater. With Epstein gone, they say, prosecutors and the press needed a villain—and she fit the bill.
But critics aren’t convinced. Survivors of Epstein’s abuse testified that Maxwell was deeply involved in recruitment and grooming. Prosecutors described her as the “key to the pyramid,” calling her Epstein’s enabler and gatekeeper.
Still, her family insists the real injustice lies in what wasn’t revealed—starting with who else might have been involved.
“It was a show trial,” Ian said. “The real secrets died with Epstein.”
Whether the court agrees remains to be seen. But with new filings imminent, and political tension surrounding the Epstein scandal still simmering, Ghislaine Maxwell’s case is far from over.
