The Obama Foundation is facing serious new legal trouble after a former employee accused the high-profile nonprofit of firing her while she was struggling with mental and physical health issues.
According to a new federal lawsuit, former curatorial assistant Tifphany McClinton claims she worked for the Foundation from mid-2023 until she was terminated in December 2025. In the complaint, she alleges the organization failed to accommodate her medical needs, ignored disturbing workplace behavior, and ultimately pushed her out after she took protected medical leave.
McClinton says she suffers from anxiety, PTSD, depression, and scoliosis, and that those conditions required certain job accommodations. Among them were time off during work hours for physical therapy and a modified schedule that would allow her to leave the office by 3 p.m. each day. But instead of receiving support, she claims she was met with pushback and resistance.
One of the most alarming accusations in the lawsuit involves a coworker who allegedly told McClinton to jump off an 11th-floor balcony to kill herself. McClinton says the comment sent her into a severe mental health spiral. She reported the incident to human resources, according to the suit, but claims no meaningful action was taken.
The lawsuit describes what McClinton says was a pattern of neglect and retaliation. She alleges her accommodation requests were never properly handled and that she was warned her reduced time in the office could damage her future at the organization. Rather than helping an employee in crisis, the Foundation is accused of creating even more pressure.
Things allegedly grew worse after McClinton began taking medical leave under the Family and Medical Leave Act. She says she used FMLA leave multiple times, including a roughly nine-week stretch in 2024, to manage her health conditions. But after returning, she claims she was hit with increased scrutiny, shifting expectations, and retaliatory treatment. She also alleges that a performance review was changed while she was out on leave.
By late 2025, McClinton says her health issues forced her to take leave again. Then, while she was still dealing with those issues, she claims the Foundation fired her. The stated reason, according to the lawsuit, was poor performance. McClinton argues that explanation was nothing more than a smokescreen for discrimination and retaliation tied to her disabilities, accommodation requests, and use of protected leave.
She is now suing under the Americans with Disabilities Act, the Family and Medical Leave Act, and Illinois state law. McClinton is seeking damages, back pay, and other relief.
The Obama Foundation has not publicly responded to the allegations.
