“They treated us like we didn’t exist,” says father as parents sue district for ignoring their pleas and hiding policy
A Texas couple is suing the Houston Independent School District (HISD), accusing school officials of deliberately undermining their parental rights by secretly treating their teenage daughter as a boy—against their wishes, and without their knowledge.
The lawsuit, filed Monday in federal court by Sarah and Terry Osborn, alleges that staff at Bellaire High School used a male name and male pronouns for their daughter over a two-year period, despite multiple direct instructions from the parents not to do so.
“This wasn’t a mistake. This was policy—and deception,” said Terry Osborn in a statement released by Alliance Defending Freedom, the conservative legal group representing the family. “They didn’t just ignore us. They actively concealed what they were doing with our daughter.”
A Hidden Policy?
According to the lawsuit, the trouble began during the girl’s freshman year, when her theater teacher reached out to confirm what pronouns should be used in class. The Osborns made it clear: female pronouns only.
But that conversation, they say, was quietly disregarded. For the next two school years, multiple HISD employees—including teachers, counselors, and administrators—allegedly referred to their daughter as male behind the parents’ backs.
They only discovered what was happening by chance, after coming across schoolwork and documents that used a masculine name.
“What we found wasn’t just disturbing—it was betrayal,” said Sarah Osborn. “Our daughter was being socially transitioned at school without our consent. That’s not education—that’s indoctrination.”
Despite multiple meetings and follow-up emails, the parents say school officials refused to provide documentation about the district’s gender identity policy or clarify whether parental notification was required.
Legal Showdown Over Parental Rights
The suit argues that HISD’s actions violated both the First and Fourteenth Amendments—by interfering with the parents’ religious beliefs and stripping them of their right to direct the care and upbringing of their child.
“This is a textbook case of government overreach,” said ADF Senior Counsel Kate Anderson. “Public schools have no authority to override a parent’s decisions when it comes to the health and identity of their own child. These parents didn’t just lose trust—they were kept in the dark.”
The Osborns are demanding a court order that would permanently prohibit the school district from referring to their daughter as male and compel HISD to update its policies to ensure parental rights are honored moving forward.
Named in the lawsuit are the principal and counselor of Bellaire High School, along with top HISD leadership. The school district has declined to comment, citing pending litigation.
A Growing National Flashpoint
The case is part of a larger national debate around parental rights in schools—especially on issues involving gender ideology. Last week, the Supreme Court upheld Tennessee’s ban on transgender medical interventions for minors, signaling a shift toward protecting parental authority over government involvement in youth gender decisions.
Conservative lawmakers in Texas and across the country have been pushing legislation that would require schools to notify parents of any changes in a child’s gender identity or pronoun use. Some states are already implementing laws that make secret gender transitions in public schools illegal.
“This lawsuit could be the tipping point,” said Rep. Chip Roy (R-TX), who has championed federal parental rights legislation. “No institution—especially not our schools—should ever keep secrets from parents. That’s un-American.”
The Osborns say they are fighting not just for their daughter, but for every parent who wants a say in how their children are raised.
“We’re not backing down,” said Terry Osborn. “This is about taking back our role as parents—and making sure no family has to go through this again.”
