In a landmark reversal fueled by the Trump administration’s aggressive civil rights agenda, the University of Pennsylvania has officially banned transgender women from participating in women’s sports—effectively erasing the controversial athletic legacy of former swimmer Lia Thomas.
The move follows a sweeping federal investigation that concluded UPenn violated Title IX—the federal law meant to ensure equal opportunities for women—by allowing Thomas, a biological male, to dominate NCAA women’s swimming events during the 2021–2022 season.
Biden-Era Controversy, Trump-Era Correction
The Department of Education, now under the leadership of Secretary Linda McMahon, announced Tuesday that UPenn entered into a voluntary resolution to avoid further legal consequences. The university has agreed to reinstate swimming records and NCAA titles to the biological female athletes displaced by Thomas’s victories. As part of the agreement, Penn must also send each of those athletes a personal letter of apology.

Lia Thomas, who competed on UPenn’s men’s team before transitioning, made headlines in 2022 after becoming the first openly transgender athlete to win an NCAA Division I national title. But what began as media celebration quickly turned into public outrage.
Many women who raced against Thomas were forced to remain silent out of fear of being labeled transphobic or losing their spots on their teams. That silence broke when former teammates like Paula Scanlan stepped forward.
“I had to share a locker room with someone who still had male genitalia,” Scanlan said in a statement following Tuesday’s announcement. “For too long, we were told our concerns didn’t matter. Today, we’ve been vindicated.”
Riley Gaines: ‘This Is What Real Equality Looks Like’
Former University of Kentucky swimmer and women’s rights advocate Riley Gaines hailed the decision as a major victory.
“President Trump said from the beginning that he’d protect women’s sports—and this is that promise fulfilled,” Gaines told Newsweek. “This isn’t about hate. It’s about fairness. The biological differences between men and women matter. And finally, a major institution is recognizing that again.”
Gaines, who now hosts the Gaines for Girls podcast on OutKick, urged other schools to take the message seriously: “Disregard Title IX at your own risk.”
From Ivy League Darling to Federal Offender
Thomas’s short but explosive rise began in 2021 after three years competing on the men’s team. Following one year of hormone therapy, she began racing on the women’s team—where her natural advantages quickly became clear.
She shattered several Penn women’s swimming records and won the national championship in the 500-yard freestyle. But she also displaced female athletes who had trained their whole lives for those moments.
In April 2025, the Department of Education concluded that this participation directly violated the spirit and letter of Title IX.
Now, under the resolution:
- All displaced athletes will regain their titles and records.
- Personal apology letters will be issued by UPenn.
- The school must publicly declare that only biological women may compete in women’s sports.
- UPenn must adopt biology-based definitions of male and female in all athletics.
The Bigger Picture: A National Turning Point
The Trump administration has made clear it is taking an uncompromising stance on this issue. The Department of Education’s enforcement arm is expected to use this deal as a model for future cases across the country.
“This sets the tone,” one administration official told us anonymously. “If you’re a school or university pushing radical gender theory over basic fairness, you better brace yourself. Title IX is back—real Title IX.”
The NCAA, which has so far avoided directly confronting the issue, has yet to comment. But pressure is mounting.
UPenn’s quiet capitulation may become a loud wake-up call for other elite institutions walking the line between political correctness and legal accountability.

Legal experts expect a wave of lawsuits and policy shifts in the coming months. Other schools with similar policies are already in the Department of Education’s crosshairs, sources say.
