Donald Trump is poised to escape an election fraud trial, even beyond his potential presidency ending in 2029. Legal experts now say that the statute of limitations will shield the former president from facing charges related to alleged efforts to overturn the 2020 election.
Neama Rahmani, a former federal prosecutor and current president of West Coast Trial Lawyers, recently told Newsweek that the clock is running out for federal prosecutors. “Once the statute of limitations expires, there’s no coming back,” Rahmani said. “The timeline for most federal crimes is five years. By winning the presidency, Trump effectively kills these cases.”
These comments underscore growing speculation about the impact of Trump’s legal victories. The former president was indicted in Washington, D.C., on four charges tied to allegedly attempting to overturn the 2020 election, which culminated in the events of January 6, 2021. Trump has consistently pleaded not guilty, framing these legal battles as part of an ongoing “political witch hunt.”
Legal Consequences on the Brink
The stakes couldn’t be higher. By defeating his legal opponents and securing another term in office, Trump could sideline federal cases permanently. Stephen Gillers, a law professor at New York University, echoed the sentiment. “It’s likely Trump will get his acting attorney general to remove special prosecutor Jack Smith,” Gillers said. “It would mirror what happened during the Nixon era, with someone else having to do the firing.”
The Nixon comparison is vivid. In May 1973, amid the Watergate scandal, Attorney General Elliott Richardson refused to fire Special Prosecutor Archibald Cox, even after President Nixon’s direct orders. The refusal led to what’s now known as the “Saturday Night Massacre,” where two senior officials resigned rather than do Nixon’s bidding. Only Solicitor General Robert Bork followed through, forever linking his name to that historic moment.
Trump’s Unwavering Resolve
Trump has made no secret of his plans. On October 26, he told conservative radio host Hugh Hewitt that, if elected, he would fire Jack Smith “within two seconds.” The statement only reinforces Trump’s determination to dismantle what he views as politically motivated attacks.
Attorney General Merrick Garland appointed Smith to bring independence to Trump’s cases, aiming to avoid perceptions of bias. “By assigning Smith,” experts suggest, “Garland was trying to insulate the Justice Department from accusations of interference. But Trump’s return to power could easily shift the balance.”
Trump’s legal saga keeps America riveted, but the clock is ticking. As Rahmani succinctly puts it, “Winning the presidency isn’t just a political victory for Trump—it’s legal survival.”

Jack Smith being appointed by Merrick Garland was never approved by Congress was just the first wrong doing by the Biden administration . And the fact that the entire Jan 6th affair was organized by a person or persons unknown on the left . To many actors have been identified via facial recognition that have ties to the Democrats and yet in their zeal to prevent further investigation to election fraud claims incited the riots and actions on that day . All the charges brought against any and all of Trump’s allies are even weaker and more baseless than those that led to the resignation of Richard Nixon . I suppose they figured it worked once it will work again . But this time they cause a riot resulting in public servants having heart attacks and the deliberate murder of a young woman protester ,this the need to try and incriminate Trump by any means available and on any charge they can and thus cover their tracks and protect them and their agents from investigation .
Trump is guilty of Tax evasion,among other crimes, but being the greatest con man of all time he will get off sacot free.
