State officials call on SCOTUS to ban males from women’s sports

Attorneys general from 24 states have joined forces to urge the U.S. Supreme Court to reinstate an Arizona law that bars biological boys from competing on girls’ sports teams. The coalition filed a petition seeking to overturn a lower court ruling that found the law likely violates the Equal Protection Clause of the Constitution.

The legal battle stems from Arizona’s 2022 law, which aimed to preserve fairness in girls’ sports by restricting participation to biological females. Supporters argue the measure protects the integrity of women’s athletics, while opponents claim it discriminates against transgender athletes.

“Sports teams are divided by sex to begin with to give girls a level playing field so they’re not competing against boys,” South Carolina Attorney General Alan Wilson said in a news release. “Arizona’s law restricting girls’ sports teams to biological females is just common sense. It protects girls from competing against bigger, stronger males who identify as females.”

A Nationwide Push for Fairness

In addition to Wilson, the attorneys general backing the petition hail from states including Alabama, Florida, Texas, and Virginia. Many of these states have enacted similar laws aimed at limiting girls’ sports teams to biological females. The officials argue that the Equal Protection Clause was never intended to prohibit sex-based distinctions in athletics.

“In sports, equal access means a level playing field,” the attorneys general wrote in their brief. “And a level playing field usually means sports teams divided by sex so that girls can compete against other girls.”

They further emphasized that biological differences, not gender identity, necessitate sex-segregated teams. “Whatever their gender identity, biological males are, on average, stronger and faster than biological females. If those average physical differences did not matter, there would be no need to segregate sports teams at all,” the brief stated.

The Debate Over Equal Protection

The legal challenge originated when a federal appeals court blocked Arizona’s law, arguing it likely violates the Equal Protection Clause. This clause, part of the 14th Amendment, requires that individuals be treated equally under the law. Opponents of the law contend that barring transgender athletes from participating in sports aligned with their gender identity constitutes unlawful discrimination.

Proponents of the Arizona law counter that the clause permits distinctions based on biological sex in situations where fairness is at stake. “Basing the distinction on biology rather than gender identity makes sense,” the attorneys general wrote. “It’s the differences in biology—not gender identity—that call for separate teams in the first place.”

The petition to the Supreme Court comes as debates over transgender athletes in sports continue to divide public opinion and legal rulings nationwide. Advocates of Arizona’s law argue that failing to protect female athletes undermines decades of progress achieved through Title IX, which expanded opportunities for women in sports.

“Allowing biological males to compete in women’s sports jeopardizes meaningful athletic opportunities for girls and women,” Wilson said. “The Constitution does not prohibit states from saving women’s sports from unfair competition.”

The Supreme Court’s decision could have far-reaching implications. If the justices agree to hear the case, their ruling may determine whether states can legally enact similar laws aimed at preserving gender-based divisions in athletics.

The case has drawn significant attention from both sides of the debate, making it a key test of how courts interpret equality and fairness in the evolving landscape of gender identity and sports.
